I’ll Just Go to the Constable for my Notice – errr…No.


I’ve had some experience with landlords who go to the Constable’s office to serve a notice.  Usually this happens because the tenant hasn’t paid and so the landlord wants a notice to be served by the Constable.  This seems to make perfect sense, right?  The Constable is an enforcement arm of the justice court so they should know exactly what notice to serve.  Well, maybe…

The thing is that when you go to the Constable, you’ll be talking to a clerk.  You’ll have discussion with the clerk about your situation and the clerk will end up suggesting what notice to send out.  If you don’t know what notice to send out, the clerk ends up being the deciding person for your notice.  These clerks aren’t necessarily the best ones to figure out what notice that ou need though!

So, in the end, it’s best if you know what notice to serve.  And, if you don’t know or if you are not sure, then give a call to an Eviction Service provider and they should give you some advice on what should be serve.  If those Eviction Service providers are service minded, it should be part of your free consultation.  Once you know what notice to serve, you can send it to the tenant the proper way – and you don’t need the Constable and you’ve sent the correct notice!

I’ve had a few landlords come to me after asking the Constable’s office to send a notice.  They ended up having to pay twice – one for the wrong notice and one for the right one.
